These Terms of Service (“Terms”, “Terms of Use” or “Agreement”) govern your access to and use of the website, products and services operated by ZEVIX (“ZEVIX”, “we”, “us” or “our”). ZEVIX operates this ecommerce store and provides related information, content, tools, products and services (collectively, the “Services”) to offer customers a seamless shopping experience.

By accessing, browsing, purchasing from or otherwise using our Services, you agree to be bound by these Terms, our Privacy Policy and our Return, Refund & Cancellation Policy. If you do not agree to these Terms, you must not access or use the Services.

1. ELIGIBILITY & USER RESPONSIBILITY

By using the Services, you represent that you are at least 18 years of age and legally competent to enter into a binding contract under the Indian Contract Act, 1872. If you use the Services on behalf of another person or entity, you confirm that you are authorised to do so.

You agree to provide accurate, complete, and up-to-date information for all purchases and interactions. You are solely responsible for maintaining the confidentiality of your account credentials and all activities conducted through your account. Accounts may not be transferred, sold or assigned to another party.

2. PRODUCT INFORMATION & WELLNESS DISCLAIMER

ZEVIX sells the EAZE Neck & Shoulder Relief Massager, an electronic wellness device intended for general comfort and relaxation only. The Product is not a medical device and is not intended to diagnose, treat, cure or prevent any disease or medical condition.

Product images, videos and descriptions are for representational purposes only. Minor variations in colour, design, packaging or finish may occur and shall not be considered defects.

Customers are advised to consult a qualified medical professional before using the Product if they have any medical condition, are pregnant, have implanted medical devices, experience chronic pain or have any health concerns. Use of the Product is at the customer’s own risk.

3. SAFE USE & LIMITATION OF RESPONSIBILITY

Customers must strictly follow all usage instructions, safety warnings and guidelines provided with the Product. ZEVIX shall not be responsible for any injury, discomfort, damage or loss caused due to improper use, excessive use, misuse, unauthorized modification, voltage fluctuation, water exposure or use contrary to instructions.

ZEVIX does not guarantee specific results, relief levels or outcomes from use of the Product.

4. ORDERS & ACCEPTANCE

Placing an order constitutes an offer to purchase. ZEVIX reserves the right to accept, reject, modify or cancel any order at its sole discretion, including orders suspected to be fraudulent, bulk or intended for commercial resale.

An order is deemed accepted only after successful payment processing and dispatch confirmation. ZEVIX may cancel orders prior to dispatch and issue refunds where applicable.

All purchases are for personal or household use only and not for resale or export.

5. PRICING, PAYMENT & TAXES

All prices are listed in Indian Rupees (INR). Prices may change without prior notice. Applicable GST or other statutory taxes, shipping, or handling charges shall be charged as displayed at checkout.

Customers represent that payment details provided are valid and authorised. ZEVIX reserves the right to correct pricing errors and cancel orders arising from incorrect pricing.

6. SHIPPING & DELIVERY

Delivery timelines are estimates and not guaranteed. ZEVIX shall not be liable for delays caused by courier partners, natural events, governmental actions, strikes or circumstances beyond our control.

Customers are advised to inspect shipments at the time of delivery and refuse acceptance if the outer package appears damaged, tampered or opened. Risk of loss passes to the customer upon delivery.

7. RETURNS, REFUNDS & CANCELLATIONS

All returns, refunds, replacements and cancellations are governed strictly by our Return, Refund & Cancellation Policy, which forms an integral part of these Terms. By placing an order, you expressly agree to comply with the conditions and procedures outlined therein.

8. WARRANTY

ZEVIX provides a limited warranty covering manufacturing defects only, as specified on the product packaging or warranty documentation (if applicable). The warranty does not cover misuse, wear and tear, accidental damage, unauthorised repairs, power fluctuations or improper handling.

Except as expressly stated, the Product is provided on an “as is” and “as available” basis.

9. INTELLECTUAL PROPERTY

All content on the Services, including text, images, videos, logos, trademarks, product designs and branding, is the intellectual property of ZEVIX or its licensors. No content may be copied, reproduced, distributed or exploited without prior written consent.

The Services may contain third-party tools or links. ZEVIX does not control or endorse third-party websites and is not responsible for their content, policies or practices. Accessing third-party services is at your own risk.

11. FEEDBACK & USER CONTENT

Any feedback, reviews or suggestions submitted grant ZEVIX a perpetual, royalty-free, worldwide license to use such content for lawful business purposes. ZEVIX is under no obligation to compensate or respond to such submissions.

12. PROHIBITED USE

Users must not misuse the Services, engage in unlawful activity, violate intellectual property rights, submit false claims, tamper with products or attempt resale without authorisation. ZEVIX reserves the right to suspend or terminate access for violations.

13. DISCLAIMER OF WARRANTIES

To the fullest extent permitted by law, ZEVIX disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. Information provided is for general purposes only and reliance is at the user’s own risk.

14. LIMITATION OF LIABILITY

To the maximum extent permitted under applicable law, ZEVIX shall not be liable for any indirect, incidental, special or consequential damages. ZEVIX’s total liability shall not exceed the amount paid by the customer for the Product giving rise to the claim.

Nothing in these Terms limits rights available under applicable Indian consumer protection laws.

15. TERMINATION

ZEVIX may suspend or terminate access to the Services at any time without notice. Obligations and clauses that by nature should survive termination shall remain in effect.

16. GOVERNING LAW & JURISDICTION

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of Gurugram, Haryana, India.

17. CHANGES TO TERMS

ZEVIX reserves the right to update or modify these Terms at any time. Continued use of the Services after changes constitutes acceptance of the revised Terms.
